Is there sin for beating one's wife and her seeking divorce after he swore she would go to her family's house?
If the wife swears to leave her husband's house: If her departure is justified, it is not permissible to strike her, and her husband striking her permits her to seek divorce. If she insists on leaving without justification, it is permissible to strike her with a non-violent blow if that is the only way to prevent her, and she is not permitted to seek divorce. Striking the wife is only permissible after exhausting admonition and boycotting.
If the husband swears to evict his wife: If there is no offense committed by her, it is not permissible for him to evict her from her home, and striking her in this case is an injustice that permits her to seek divorce.
In the case of a wife's disobedience (nushooz): Her right to maintenance and housing is forfeited, and the husband is permitted to evict her. She is not permitted to seek divorce because she is the cause.
