What is the ruling on committing zina with a deceased person?

Scholars unanimously agree on the prohibition of committing zina (unlawful sexual intercourse) with a deceased person. However, they differ on whether the hadd punishment is obligatory for the perpetrator. The Malikis deem it obligatory, while the Hanafis consider only ta'zir (discretionary punishment). The Shafi'is and Hanbalis hold differing opinions on the matter.

Thus, one who commits zina with a deceased person commits a grave sin, and the minimum punishment for him is ta'zir.
