What is the ruling of the Sharia on dealing with the wife's father who used the spouses' documents to obtain a usurious loan in their name to purchase a property, while refusing to sell the property to pay off the debt, and is it obligatory to continue paying the installments, or to file a lawsuit against him, or to sell the apartment for less than his asking price, and does Hajj take precedence over settling this dispute?
A man who does not adhere to the pillars of Islam is in grave danger, and he should be advised to repent and prayed for to become righteous. He should also be advised to fear Allah in his dealings with people, and some virtuous and righteous individuals should be assigned to him to rectify his situation. If the mediators fail to convince him, it is permissible to resort to man-made laws to repel injustice. Selling the house is a solution to the problem, and reclaiming one's right is permissible with caution. There is no harm in performing Hajj before the problem is resolved if one has the ability to do so; in fact, one must hasten to perform it if it is the Hajj of Islam.
