Is it permissible to take out a usurious loan due to necessity, or to sell an apartment to my brother and then buy it with an Islamic loan, in order to pay off a mortgage on my father's friend's house amounting to 26,000 dinars, after my father became unable to pay his usurious debt?

It is not permissible to borrow with interest (riba) to pay off a father's debt, nor is it permissible to use trickery against an Islamic bank to conduct a fictitious murabaha transaction; because it is a forbidden stratagem that leads to an interest-based loan. The Prophet, peace and blessings be upon him, said: "Do not commit what the Jews committed, so you make lawful the prohibitions of Allah with the slightest stratagems." Instead, a tawarruq transaction can be conducted with an Islamic bank or the apartment can be sold.
