Is the amount awarded permissible or impermissible in Sharia, if her ex-husband swore not to forgive its taking?

1 min readAlso available in العربية

If the Sharia judge rules in favor of a woman receiving money, she has the right to take it, and her husband is not permitted to prevent her. His supplication against her will not harm her as long as she took it rightfully. If the husband does not spend on his children and the wife spends on them with the intention of recovering the maintenance from him, she is permitted to do so. It must be noted that a judge's ruling does not make lawful what is unlawful if it is based on false testimony or a false oath; in such a case, it is not permissible to take the money that has been ruled upon.
