What is the ruling on directing a decisive oath to the wife and her father in court, and what is the recompense for one who swears falsely by Allah while knowing?
If it is true that the husband shared with his wife in purchasing the car and registered it in her name, and then she denied his right, she has committed a grave sin. If he has no proof, his only recourse is to demand an oath from her, as the Prophet, peace and blessings be upon him, said: "The burden of proof is upon the claimant, and the oath is upon the one who denies." If she swears falsely, then the saying of the Prophet, peace and blessings be upon him, applies to her: "Whoever swears an oath by which he wrongfully appropriates the property of a Muslim, meets his Lord, and He is angry with him." We advise the husband to counsel his wife and remind her of Allah and His punishment, and of good companionship and kindness, as Allah Almighty says: "And do not forget graciousness among yourselves."
