The marriage is invalid if it takes place without the consent of the father, who has the primary right to give his daughter in marriage. The annulment of this marriage is considered a divorce because it is a disputed type of marriage. The divorced woman must observe an iddah (definition) of three menstrual cycles if she menstruates, or three months if she does not menstruate due to young age. The father's refusal to marry off his daughter because there is an older daughter is contrary to Islamic law; therefore, he must hasten to marry off his daughter if a suitor of good character and religiosity comes to her.
