Is it permissible for non-Muslims to benefit from the provisions of Khulʿ?
There is no harm in non-Muslims benefiting from Khul' (dissolution of marriage at the wife's instance) to resolve their disputes or when they seek our judgment, because we judge them according to what Allah has revealed, and this includes Khul', as Allah Almighty says: "So judge between them by what Allah has revealed and do not follow their inclinations" (Quran 5:49). However, they will not be rewarded for adhering to it or for being compelled to it, because they do not believe in it as a legitimate ruling, and because a disbeliever's adherence to the branches of Sharia is not accepted unless they accept its foundation, as in His Almighty saying: "And what prevented their contributions from being accepted from them is nothing but that they disbelieved in Allah and in His Messenger" (Quran 9:54).
