Is the marriage valid if a man divorces his wife and her waiting period ends, then he asks his relative to film the statement, "I marry you, my daughter, according to the Book of Allah and the Sunnah of His Messenger," on camera, with his acceptance of that, and making the tape a witness to that before two just witnesses? And does the ruling differ if the two witnesses were present at the time of filming?

A suitor who speaks of a past marriage, and does not intend to establish a new marriage contract, his marriage is not contracted by this statement, whether he says it seriously or in jest. This ruling also applies to divorce; for narration does not effect it. The decisive factor is the speaker's intention, not merely repeating words, whether for the purpose of teaching or narration, so the marriage is not contracted, and bearing witness to it in this manner is not valid.
