What is the legal ruling for a husband to have intercourse with his wife during the daytime in Ramadan out of ignorance, and what must be done after repentance and seeking forgiveness?
An ignorant person is excused for engaging in intercourse during the daytime in —if they were unable to learn the religious rulings, such as a recent convert to Islam or someone raised in a remote desert region. In such cases, there is no make-up fast (qada') nor expiation (kaffara) due upon them. However, if someone was ignorant of the necessity of expiation, yet aware of the prohibition of intercourse, the expiation is not waived for them. As for someone who is able to learn, they are not excused for their ignorance and are sinful due to their negligence. Expiation and repentance are obligatory upon them if they engage in intercourse during the daytime in Ramadan.
