Is a husband's action of going to a ma'dhoun (authorized marriage official) to create a fictitious divorce paper, intending to present it to the family of a girl he wishes to marry, considered a valid Islamic divorce, knowing that the wife was not present and had been divorced by him twice previously?

If a husband obtains a divorce certificate for his wife without uttering or writing words of divorce, it is not legally binding. However, if he explicitly pronounces a divorce, it takes effect even if he did not intend it. Similarly, if he writes it, it takes effect according to some scholars, even if he did not intend it. It is important to know that the wife remaining married to her husband while a divorce certificate has been officially issued entails great harms.
