This transaction is considered a loan, and the woman must pay zakat on this money when a year has passed, or when she takes possession of it for past years. It is not permissible for her to stipulate that the man pay zakat on the loan, because it would then be a loan that yields a benefit (riba). However, if the money is a Mudarabah (partnership in profit), then she pays zakat on it and on the profit every year, and the zakat should be paid from the profit before it is divided. If she stipulates a percentage of the profit for herself and then leaves it to him after paying zakat, this is permissible, provided that he does not guarantee the capital except in cases of transgression or negligence.
