If a woman leaves her husband's house without his permission and without necessity, she is sinful and rebellious (nashiz), and her right to maintenance (nafaqa) is forfeited unless she is pregnant. She must repent and return to her home and live with her husband in kindness. However, if she leaves due to harm inflicted upon her, there is no sin upon her, and her husband is obligated to provide for her maintenance. She also has the right to refer her case to a judge to remove the harm or to rule for divorce due to the harm.
