The father's estate is not distributed as long as he is alive. If he bestows his wealth upon his children, it is permissible if he deals justly between them or if some of them agree. If a father permits his son to build on a plot of land, the son does not own the plot merely by this permission. If the son comes to own it, and the rest of the siblings agree, then the gift is valid, and the father may revoke it under certain conditions, based on the Prophet's (peace be upon him) saying: "It is not permissible for a man to give a gift and then take it back, except for a father in what he gives to his child." Accordingly, the father can sell the land and divide it equally among his children, or he can favor some of them with a portion of it, with the consent of the others.
