Will divorce occur if the wife goes to a dentist accompanied by her husband, after the husband had stipulated her divorce with the triple repudiation upon her going to the dentist, intending to prevent her from going alone, and can this condition be annulled?

Most scholars are of the opinion that swearing by divorce results in divorce upon breaking the oath, and that uttering "divorce by three" counts as three divorces. Shaykh al-Islam Ibn Taymiyyah, however, holds the view that swearing by divorce when the intention is not to effect divorce but rather to threaten or emphasize, falls under the same ruling as swearing by Allah. In such a case, breaking the oath necessitates an expiation for an oath (kaffarat yamin) and does not result in divorce.

Our adopted fatwa is that if you break your oath, your wife is divorced three times. However, according to Ibn Taymiyyah's view, no divorce occurs as long as you did not intend divorce, and you must pay an expiation for an oath (feeding ten poor persons, or clothing them, or fasting three days).

Breaking your oath depends on your intention: - If you intended to prevent your wife from going alone, then her going with you does not break the oath. - If you intended to prevent her from going at all (whether alone or with you), then her going with you breaks your oath.

It must be noted that the lawful oath is to swear by Allah the Almighty, and swearing by divorce is among the oaths of the dissolute.
