Is divorce effected by the words "I have taken you back, O so-and-so" if it becomes clear that the original divorce did not take place?
A man's statement to his wife, "I take you back, so-and-so," out of fear that a divorce might have occurred, does not bring about a divorce. Sheikh al-Islam Ibn Taymiyyah said: "And if he takes precautions and takes his wife back fearing that a divorce might have occurred, or believing that a divorce has occurred: it does not take place."
