Does uttering "talaq talata" (I divorce you thrice) during a quarrel constitute a divorce if the speaker is unaware of the gravity of the statement, and can the wife be taken back in such a case?

The majority of scholars hold that swearing by divorce results in divorce upon breaking the oath, and that pronouncing divorce three times counts as three divorces. This is the fatwa given. However, Sheikh Al-Islam Ibn Taymiyyah is of the opinion that swearing by divorce, when the intention is not to make the divorce contingent, takes the ruling of an oath by Allah, and requires an expiation for an oath (kaffarat yamin) upon breaking it. He also holds that pronouncing divorce three times counts as a single divorce. Accordingly, if you have broken your oath, your wife has been irrevocably divorced from you (baynunah kubra). The determination of what constitutes breaking the oath refers back to your intention and purpose. It is preferable to present these matters to a Sharia court or trusted scholars.
