Is selling building materials, taken from the Orphan's Fund Development Foundation for four thousand dinars, to a person other than a merchant considered unlawful?
Installment or deferred sale, with the intention of selling the commodity and benefiting from its price, is called 'Tawarruq' sale. This is when one buys a commodity for a deferred price, then sells it for a spot price to someone other than the original seller, at a lower price than the deferred price, in order to obtain cash. The majority of scholars permit it, and this is the most preponderant opinion, due to the generality of Allah’s saying: "Allah has permitted trade," and because there is no apparent intention or form of usury in it. However, 'Umar ibn 'Abd al-'Aziz and Muhammad ibn al- al-Shaybani disliked it, and Ibn Taymiyyah and Ibn al-Qayyim chose to prohibit it.
