Divorcing a wife during her menstruation or post-natal bleeding (nifas), or during a period of purity (tuhr) in which the husband has had intercourse with her, is impermissible. This is a matter of consensus and is referred to as a "bid‘ah divorce" (innovative divorce) because it contravenes the Sunnah and disregards the command of Allah the Almighty and His Messenger. The "Sunnah divorce" is when a man divorces his wife with a single pronouncement during a period of purity in which he has not had intercourse with her, and then leaves her until her waiting period (‘iddah) expires.
