Does a divorce issued by a husband while under the influence of Captagon and alcohol, as a result of a dispute with his wife, take effect?
Scholars have differed regarding the divorce pronounced by an inebriated person. The preponderant opinion is that if he has lost his awareness, his divorce does not take effect. However, if he is aware of what he is saying, then his divorce is effective. Accordingly, if you were not aware of what you were saying, the divorce is not enforceable. But if you were aware, then your divorce is enforceable, and you may take your wife back if the divorce count has not reached three and before the expiration of her waiting period (). It must be emphasized that consuming intoxicants and drugs is among the major sins, and you must offer sincere repentance.
