Can a man who divorced his wife irrevocably (with three pronouncements) return to her after she contracted a marriage with another man and claimed that he had secretly consummated the marriage with her before they were alone together, and then she annulled the contract before the wedding? And is it permissible for him to ask her to swear by Allah to confirm whether consummation occurred?

If a man divorces his wife with a triple divorce, and she claims that her iddah (definition) (waiting period) has ended, and that she married another man and was divorced by him, and a sufficient time has passed that allows for her truthfulness, then the first husband may marry her again with a new contract. If he suspects her of lying, then piety dictates that he should keep away from her, though this is not obligatory. The Malikis permit this, provided that the wife's khalwah (private seclusion) with the second husband is established.
