What is the ruling on someone who completed the Umrah of Tamattu' then left Makkah to visit Ta'if, or Jeddah, or Madinah, and wished to return to Makkah days before the Day of Tarwiyah? Should he remain in his state of ihram throughout these days if he intends to enter into ihram from the miqat? Or is it permissible for him to return to Makkah without ihram, then return to the miqat on the seventh or eighth day of Dhul-Hijjah to enter into ihram from there?

Scholars differ concerning the mutamatti‘ (one performing umrah then hajj in the same journey) who travels after performing umrah during the months of hajj and before the Day of Tarwiyah (8th of Dhul-Hijjah): does his tamattu‘ cease, obligating him to enter into ihram upon returning to Makkah, or not?

The Hanbalis hold that his tamattu‘ ceases, and the sacrifice of tamattu‘ is dropped. He must enter into ihram from the miqat upon his return. They cite the saying of Umar (may Allah be pleased with him): "If he performs umrah during the months of hajj and then stays, he is a mutamatti‘. But if he leaves and then returns, he is not a mutamatti‘."

Others, including Ibn Uthaymeen and Ibn Baz, believe that he remains a mutamatti‘ and is not obligated to enter into ihram upon his return; rather, he enters into ihram from Makkah on the Day of Tarwiyah. His departure for a need or a visit does not remove him from being a mutamatti‘, and he is still required to offer the hady (sacrifice) of tamattu‘.
