Does what was narrated about Ziyad's vision of Al-Mughira ibn Shu'ba, and what he mentioned about "a soul ascending, or an anus recoiling, and her legs on his neck as if they were donkey's ears," affect Al-Mughira's integrity, knowing that Umar dismissed the testimony? And are there penalties in Islam for the preliminaries of fornication, and what did Umar (may Allah be pleased with him) do to Al-Mughira if the preliminaries of fornication were proven against him?

The Companion Al-Mughira ibn Shu'ba was among those who pledged allegiance in the Pledge of Ridwan, whom Allah was pleased with, and whom the Prophet (peace be upon him) testified were good and destined for Paradise. His first participation in a major event was at Al-Hudaybiya. As for what has been reported in multiple narrations accusing him of fornication, the required number of witnesses was not established for it. Umar (may Allah be pleased with him) flogged those who brought the accusation because the testimony was incomplete. The narrations about his actions with the woman are either unsound in their chain of transmission or the woman was his wife, which explains why Umar appointed him as a governor after the incident. As for the ruling of Sharia on the preliminaries to fornication, they are immoral acts, but no legal penalties (hudud) are applied for them except in cases of actual penetration. The ruler may inflict a discretionary punishment (ta'zir) upon the perpetrator.
