If the injury was deliberate, then qisas (retaliation in kind) is obligatory, unless it results in the death or disfigurement of the perpetrator. In this case, no diyah (blood money) is required unless it has been agreed upon. However, if qisas is not possible due to fear of the perpetrator's death, then arsh (compensation) is obligatory. The ruling on cases of injuries and qisas falls under the exclusive jurisdiction of the Sharia judges; no one else is permitted to rule on them. If the injured party takes money in exchange for the injury, he may dispose of it as he disposes of his other possessions.
