What is the ruling on someone who goes for 'Umrah while obligated to pay a fidyah from a previous 'Umrah that they have not yet paid?
It is permissible to enter into for ' at any time of the year, unless a person is already in ihram for a previous 'Umrah. In that case, according to the majority of scholars, it is not permissible for him to enter into ihram for another 'Umrah before exiting the state of ihram from the first.
Among the impediments to entering into ihram is the lingering effect of a previous ihram, such as if one omitted a required act in the previous ihram. In such a case, it is not permissible for him to enter into a new ihram until he fulfills the compensation.
The Hanafis, however, differed, permitting entering into ihram for 'Umrah while already being engaged in a previous 'Umrah. They also allowed entering into ihram if the throwing of the Jamrat al-Aqabah on the Day of Sacrifice was not performed and the Days of Tashreeq passed, in which case entering into ihram for 'Umrah is prohibited before fulfilling its compensation.
