Is it permissible to say: "If the person is rich, I will take a compensatory fine, and if he is poor, I will forgive him," or vice-versa? And is forgiveness conditional on financial considerations or not?

Forgiving the one who caused the accident is better than taking one's right from him, whether he is rich or poor, as Allah Almighty says: "And that you pardon is nearer to righteousness," and "But whoever pardons and makes reconciliation - his reward is due from Allah," and "And whoever is patient and forgives – indeed, that is of the matters [requiring] determination."

Forgiveness and overlooking were the character of the Noble Prophet. Nevertheless, the injured party has the right to charge the party responsible for the costs of repair.

If a person forgives the poor without forgiving the rich, he will be rewarded for forgiving the poor, and there is no blame upon him for not forgiving the rich. Rather, if he forgives one poor person but not another, he will be rewarded for the one he forgave, and there is no blame upon him for the one he did not forgive.
