Is it permissible to have intercourse with one's wife at night, given her fear of illness from performing ghusl due to the intense cold, and her delaying ghusl until before noon after performing tayammum for prayer?
A husband may have conjugal relations with his wife whenever he wishes. If the wife is able to perform (ritual bath), it is obligatory for her to do so. If she is unable and fears harm, she should perform (dry ablution) and pray.
Shaykh al-Islam Ibn Taymiyyah was asked about this issue and he replied that if someone is in a state of (major ritual impurity) and is unable to perform ghusl due to lack of water or because using it would cause harm (such as being ill or the weather being cold), then they should perform tayammum and pray. They should not delay the prayer beyond its prescribed time. A woman is not permitted to refuse her husband conjugal relations; rather, she must obey him. If she is able to perform ghusl, she should; otherwise, she should perform tayammum.
