What is incumbent upon a father to do regarding his divorced, deviant daughter and her children, knowing that she is undutiful (aqqah) and misuses their allowance, and the children’s father visits them weekly—is she qualified to have custody of them?

The father must forbid his daughter from evil deeds and strive to reform her and help her repent. If she does not repent and remains in her state, and he is able to take her in to prevent her from evil deeds without causing a greater harm, then he should do so, because an untrustworthy, previously married woman (thayib) is to be kept close. As long as the daughter is in a state of immorality, she is not trustworthy to have custody of children. Therefore, custody can be transferred to someone else who will protect and care for the children. Otherwise, the matter should be referred to the judiciary to decide what is in the best interest of the children.
