Regarding the husband's statement, "If you leave, you will not be under my عصمة (bond of marriage)," this is a kinayah (an ambiguous statement) by which divorce does not occur unless the husband intends divorce and the condition (the wife leaving the house) is met. This oath is restricted by the intention of the one who makes the oath and the reason for the oath, and the oath ceases when its reason ceases. As for his statement, "I will leave you" if the house is not tidy, this is a kinayah by which divorce does not occur. If the husband intended divorce by it, then it is a promise, and a promise of divorce is not a divorce.
