The question

Does the delay in settling stock trades to two days (T+2) affect the validity of the lawful قبض (seizure/possession) in buying and selling stocks, knowing that the purchased securities can be sold or the seller can obtain the purchasing power immediately after the execution of the trade without waiting for settlement?

The answer

Whoever sells shares and the money is delayed in reaching their account, it is not permissible for them to purchase with that money until they have actually received it.

According to the resolution of the Islamic Fiqh Academy, the possession of funds is achieved physically (by hand, measure, weight) and constructively by vacating and enabling disposal. The manner of possession differs according to the nature of the item and custom.

Examples of valid constructive possession include: - A bank entry of an amount into a client's account if deposited directly or by transfer, or if it resulted from an immediate exchange contract, or a transfer from one account to another. A delay in the bank entry for customary periods is forgiven, provided that the beneficiary does not dispose of the currency during this period except after the possibility of actual receipt. - Receiving a check if it has a withdrawable balance.
