What is the ruling of Islamic law regarding the marriage of a woman who committed adultery if her current husband knows about her past, and does verbal and telephonic divorce occur with the phrase "You are divorced" repeated three times, and what rights does the wife have as a result?
We ask Allah to mend the questioner's affliction. We advise her to perform sincere repentance, for whoever repents, Allah accepts their repentance. There is no use in looking back at the story of the first husband, as the ties between you have been severed. As for the last husband, his family can reconcile between you if they love her, and two divorces leave one last chance for her return. If the last divorce occurred during the 'iddah (waiting period) of the first divorce before he took her back, then it does not count, and only one divorce remains. However, the problem is that the husband was affected by what he heard about her past, and not everyone can overcome that. If she cannot find anyone to reconcile between them, then she must be patient, and perhaps Allah will expiate her sin through it.
It is not a condition for the validity of divorce that it be in front of a shaykh or an authorized official; rather, it occurs whenever the husband pronounces it according to its legal conditions. Divorce must be documented to preserve rights. The husband's statement that she deserves nothing is oppression and slander, for she has her full rights even if she committed fornication and repented. Indeed, even if the fornication occurred during their marriage and he divorced her, he would still be obliged to give her all her rights.
We console the questioner and remind her to increase in righteous deeds and to have good expectations of Allah. If she can move to another town far from whoever exposed her, there is good in that for her to start a new chapter, and it is preferable for that to be in a Muslim country.
