The reference for this is the one who made the oath; if he uttered it unintentionally, then it is a laghw (unintentional) oath, for which there is no expiation, based on the statement of Aisha: "Laghw oaths are what occur in argumentation, jesting, joking, and speech upon which the heart does not firmly intend." However, if he intended it, then it is a ghamus (perjurious) oath.
