Is it permissible for a non-Muslim to hold a judicial position in a Muslim state?

It is a condition that the judge be a Muslim when adjudicating among Muslims, because it is impermissible for anyone other than a Muslim to rule for or against a Muslim. It has been reported from Qadi Iyad that the conditions for judgeship, without which it cannot be fulfilled, are ten, the first of which is Islam.
