Is it permissible to build a new commercial establishment on private property, even though the previously allowed legal area has been exceeded?

The basic principle is that an owner has the freedom to dispose of their property, and the ruler may only prevent them from doing so for a public interest, such as widening a road or for reasons of security and safety. However, preventing them without a public interest is not permissible. In this case, there is no sin upon a person for violating the law if their violation does not result in harm or discord. Al-Haytami holds that what the ruler commands without a public interest does not need to be obeyed except outwardly.
