He who comes to Mecca for 'Umrah during the months of Hajj and intends to stay there until Hajj, is a mutamatti' (one performing tamattu') and must offer the hady (sacrifice) of tamattu'. A person becomes a mutamatti' simply by entering into ihram for 'Umrah during the months of Hajj while intending to perform Hajj in the same year, even if he did not explicitly intend tamattu'. The hady of tamattu' is waived by returning to one's hometown and then returning to Mecca, entering into ihram for Hajj alone. If the mutamatti' cannot find a hady, he must fast three days during Hajj and seven when he returns to his family. Continuity in fasting is not a condition. If he is unable to fast, then there is nothing upon him. He who performs 'Umrah during the months of Hajj and then returns to his hometown, his tamattu' is severed.
