The majority of scholars hold that swearing an oath by divorce results in divorce upon breaking the oath, and that uttering the triple divorce pronounces three divorces. This is the established ruling. However, Sheikh al-Islam Ibn Taymiyyah is of the view that swearing an oath by divorce, when the intention is not to effect a divorce but rather to threaten or emphasize, is akin to swearing an oath by Allah. Thus, upon breaking the oath, an expiation for an oath becomes obligatory, and no divorce occurs. He also holds that uttering the triple divorce pronounces a single divorce. Therefore, if the wife gets into the car with the intention of driving it, three divorces occur, and the wife becomes irrevocably divorced (baynunah kubra). Intention specifies the general and restricts the absolute in an oath. It must be known that the permissible oath is by Allah Almighty, and swearing an oath by divorce is among the oaths of the wicked.
