If a father abuses his wife and children and fails to provide for them, he is unjust and sinful, as the Prophet (peace be upon him) said: "It is sufficient sin for a man to neglect those whom he supports," and "O Allah, I declare inviolable the rights of the two weak ones: the orphan and the woman." However, his injustice does not negate his right to filial piety and good companionship.

As for his statement to your mother, "You are divorced," it is an effective divorce if he uttered it willingly and with full awareness. If he repeated it three times or said, "You are divorced by three," then his divorce counts as three, and the major irrevocability (al-baynunah al-kubra) occurs. If your mother is certain that he divorced her three times, it is impermissible for her to allow him to be intimate with her, and she must separate from him, even if it is through khul'.
