Divorce occurs upon its suspension if the wife uttered the phrase and the husband was aware of it. His unawareness of her pregnancy does not affect the occurrence of the oath. Conditional divorce takes effect upon the fulfillment of the condition, regardless of the husband's intention. Some scholars, such as Ibn Taymiyyah, are of the view that a conditional divorce not intended to effect divorce is treated like an oath, and the husband is liable for an expiation for an oath (kaffarat yameen). If someone conditions divorce upon multiple actions and then breaks the condition for each of them, a divorce occurs for each action. It is advisable to present the matter to trustworthy scholars.
