If the company does not transfer ownership of the allocated amount for the meal to the individual, but rather earmarks it to cover the actual expense up to a maximum limit, then it is not permissible for him to take the full amount if his actual expense was less. He is also not entitled to anything if he did not eat at all. However, if the company transfers ownership of the amount to him as compensation for what travel necessitates, then he is permitted to take it regardless of his actual expense.
