The profit derived from the restaurant is permissible (halal) for the questioner and his younger brother if the restaurant's business is separate from the sale of prohibited items like tobacco. As for being free from sin, it requires the two brothers not to assist their brother in selling prohibited items, and to enjoin what is right and forbid what is wrong. If the elder brother sells shisha in the shared restaurant and uses its equipment, this does not absolve them of responsibility. It is necessary to dissolve the partnership if possible, so that the restaurant becomes free from the sale of prohibited items.
