What is the ruling on a husband having intercourse with his wife during the daytime in Ramadan without ejaculation, and is expiation (kaffarah) obligatory for both the husband and wife if they are unable to emancipate a slave or fast for two consecutive months?

Whoever has sexual intercourse with his wife during the daytime in Ramadan while he is fasting and a resident, must offer a severe expiation (kaffarah mughalladhah) along with repentance and making up that day. This expiation is: freeing a slave; if he cannot find one, then fasting for two consecutive months; if he is unable to do that, then feeding sixty poor people. The same applies to the woman if she was willing. The expiation becomes obligatory merely by penetration, whether ejaculation occurred or not.

As for the traveler, there is no sin upon him and no expiation; he only needs to make up the day.

Whoever has two homes, one in his city of residence and the other in another city he visits during holidays, is considered a resident in both homes, and must fast and complete his prayers.

If sexual intercourse occurred before entering the city (and you were a traveler), you only need to make up the day. However, if sexual intercourse occurred after entering the city (and you were a resident), you must offer expiation along with making up the day and repentance.

If expiation becomes obligatory, try to fast the two consecutive months during cool or moderate days, or during holidays. If you are unable, then feed sixty poor people. Your wife is bound by the same rulings.
