It is permissible to sell date palms before they bear fruit, as well as to sell date palms that have borne fruit before the fruit's صلاح (suitability for consumption) becomes apparent. This is based on the Prophet's (peace be upon him) saying: "Whoever sells date palms that have been pollinated, their fruit belongs to the seller, unless the buyer stipulates otherwise." Thus, the pollinated fruit remains with the seller, while the unpollinated fruit belongs to the buyer. This does not contradict the prohibition of selling fruit before its صلاح becomes apparent, because selling the palm tree includes the fruit as a subsidiary part, whereas the prohibition relates to selling the fruit independently of the palm tree.
