What is the ruling on a marriage between a Coptic Egyptian doctor and a Filipina without witnesses or an authorized officiant, and what is the ruling on his actions towards her with repeated divorce and reconciliation, and his failure to provide for her and his Egyptian wife and daughters in a befitting manner?
A lawful marriage has pillars, among which are the صيغة (nuptial formula) between the two parties to the contract, the guardian's permission, and the presence of witnesses. If the woman's guardian or his agent does not contract for her, and two Muslim witnesses are not present, then the contract is invalid, and the woman must be separated from immediately. Marriage is one of Allah's signs and a great ritual that should not be trifled with. Allah the Almighty said: "And of His signs is that He created for you from yourselves mates that you may find tranquility in them; and He placed between you affection and mercy. Indeed in that are signs for a people who give thought," and "And do not take the signs of Allah in ridicule." If the marriage was valid and the man divorced his wife with a revocable divorce, he may take her back during her waiting period () without a new contract. If the man does not provide for his family and children, he must fear Allah and know that he is responsible for them, for "It is enough sin for a man to neglect those whom he is responsible to feed."
