How can a husband prove his wife's disobedience (nushuz) legally and according to Sharia, considering that she has left the marital home and moved to live with her family, is seeking employment, and there is a daughter between them?

A wife's insubordination (nushooz) is her disobedience and defiance towards her husband. If the wife leaves her husband's home and goes to her family's house, or takes up a job without his permission and without a valid excuse, then she is considered insubordinate (nashiz) Islamically. The husband should be patient and strive for reconciliation. He may send some wise individuals from his and her families to seek a solution with her father. If a solution cannot be reached, then it might be preferable for him to divorce her. In the event of a dispute regarding insubordination or rights, it is best to refer the matter to the Sharia (definition) court.
