What is the religious ruling on the father and brother refusing to remove the living fetus from the womb of the deceased mother?
A living fetus must be saved if it can be extracted in the usual manner. If it can only be extracted by a Caesarean section, there is a difference of opinion, and the preponderant view is to prohibit it. The father and brother are not obligated to pay blood money (diyya) or expiation (kaffara), because, according to the majority of scholars, failing to save an innocent life does not entail financial liability. However, they may be sinful if they were capable of saving it. If the child could have been extracted in the usual manner and one of them deliberately did not extract it, then he must repent and seek forgiveness, and neither expiation nor blood money is obligatory upon him.
