Does divorce take effect with the husband's words to his wife, "So, are you divorced now?!" if he intends to respond to her words and not to initiate a divorce?

The majority of scholars hold that divorce occurs if one swears by it and then breaks the oath. However, others—including Ibn Taymiyyah and Ibn al-Qayyim—are of the view that divorce does not occur if the husband did not intend for it to happen, and an expiation for breaking an oath is due. As for the husband's statement, "Meaning, are you divorced now? So what does that mean?", since he has stated that he did not intend to effect a divorce but rather to inquire and seek clarification, then no divorce occurs.

The husband is advised to refrain from swearing by divorce due to the casualness and trifling with the Book of Allah it entails. The Prophet, peace be upon him, considered anyone who divorces his wife three times simultaneously to be trifling with the Book of Allah.

The Prophet, peace be upon him, forbade excessive swearing by other than Allah, and guided anyone who wished to swear an oath to swear by Allah or remain silent. A believer should only swear by Allah and should not swear excessively.
