Is blood money obligatory for whoever carries out a legal (Shar‘i) حدd punishment that leads to the death of the one being punished, such as flogging or amputation?
If the Imam or the ruler carries out the legal Hadd (punishment) upon its deserving recipient in the prescribed legal manner, and as a result a limb is damaged or the punished person dies, there is no liability; because the right (of God/law) was the cause of that, unless he exceeded what is prescribed, in which case he is liable. The scholars have unanimously agreed on this, based on the principle that what arises from something permissible has no legal consequence. As for anyone other than the Imam or his representative, it is not permissible for him to carry out the Hudud, and he is liable if he carries them out and the punished person dies.
