If the sale does not include an option (khiyar), then the sale is concluded upon separation from the contract مجلس (gathering), and zakat is obligatory on the portion of the price received once a hawl (lunar year) has passed over it. As for what remains in the buyer's possession, zakat is not obligatory on it until it is received, and then it is to be paid for one year.

If a hawl has not passed on the received portion, the seller can rescind the contract and reclaim his land if the buyer is procrastinating or insolvent. However, if the sale includes an option (khiyar), there is a difference of opinion among scholars regarding the obligation of zakat, but the preponderant opinion is that ownership transfers to the buyer upon the contract itself, and zakat becomes obligatory on him.
