The husband is not allowed to refuse to provide independent and suitable accommodation for his wife if he is able to do so, even if the wife did not stipulate it. This is based on the Almighty’s saying: "Lodge them [wives] where you lodge yourselves, according to your means, and do not harm them to make their lives difficult."

The husband must provide a separate home if the wife refuses to live with her co-wife or her in-laws, due to the potential harm and damage this may cause, and his need to have conjugal relations and companionship with her freely.

If the wife stipulates independent accommodation, this right is affirmed by the Prophet, peace and blessings be upon him, who said: "The conditions most worthy of fulfillment are those by which you make intimate relations lawful."

The husband must balance the rights of all parties and provide independent accommodation if he is able.

If the husband does not respond to the wife’s request for independent accommodation, whether due to inability or stubbornness, she has the right to refuse to live with him until he provides it. If he persists in his refusal, she has the right to refer the matter to the Sharia court and request annulment of the marriage.
