Whether the seller says to the broker: "Sell this property for such-and-such a price, and whatever is in excess is yours," or the broker says: "I will sell this for such-and-such a price, and whatever is in excess is mine," and the seller agrees to that; then the excess belongs to the broker, in addition to the brokerage fee that he stipulated and the seller agreed to. The broker selling the property at a higher price is not considered deception of the buyer, provided he does not lie or mislead him. The broker may take his fee from the buyer, or be content with the excess he obtains from the sale.
